You should check first if your marriage is valid ,if it is then get it annulled ,you were mad giving up a pension ,get legal advice and state you wish to get you pension back .

Im not an expert, but if your husband is dead you no longer have a husband and his koseki toroku would come to an end. His sons are listed on his toroku and when they marry set up their own koseki. Foreigners can not have their own koseki. If he is dead that doesnt stop you marrying anyone else though.

If he is still legally married in the US then technically that means he is committing bigamy if he marries you as well. Could get quite messy. You may need the help of an immigration lawyer and they want to make sure you are not just marrying him to get a green card. It could be a hold up with the INS as well if they check into his ex-wife etc.

I am not an expert (at anything) but I would guess that if he was not legally clear to marry then that could be grounds ,but you need legal advice from a Japanese lawyer ,and whether your pension status can be reversed .(as you were not legally married ).Try your hardest to get this pension back ,as it looks as though you need it.If he has already switched states
he does not sound stable Sorry to be negative ,sorry hear about your troubles.What is your nationality ?

Let me get this right....you are paying half his rent on his apartment in the US, and you dont even live there and cant get a valid visa?

Sorry to be blunt but he sees you have 'sucker' written all over you if you are sending him money to pay his rent, while he does nothing about your visa. I would pull the plug on this deal NOW. It sounds like you are counting on him and are desperate to get married.

If he is still married to someone else, your marriage is NOT valid until his first marriage is annulled or he has a divorce come through. The only perosn you are kidding is yourself.

An annulment usually takes place if the spouse is a Catholic as the Church does not recognise divorce. You can get an annulment if thre spouse is already married or one of you is underage.

I have to pay 2,800,000 for my late husbands Hospital for 2 weeks , he died because of fever. And also Funeral 1,700,000. Asked help fro his parent his 2 sisters and oldest brithere but they just argue, so much discussion. ending up I did not get ant financial help.

Just curious, what did your husband provide for you in his will? Maybe you can go to the lawyer make sure that you are protected in his will. Sell his house and assets to pay the funeral costs etc.


PS I read your post on the other thread. Im sorry to hear about all the troubles you went through. By law Japanese kids are supposed to be in school and they dont like kids taking too much time off as they get behind. My daughter took three weeks off so she could travel to New Zealand as he cousins were off school at that time, but generally schools here dont like kids being off school unless they are sick.

This whole thing with the new husband abd visas etc in the US stinks to high heaven and I would get some closure as soon as possible.

I recommend you get a lawyer here to deal with the pension office as all you will get is the runaround from bureaucrats. the fact you are Filipino wont help things as deep down, this is a racist and xenophobic society, whether or not your husband was japanese. You have to fight fire with fire and show them you mean business and that they are are stealing from you.
