    Default Parking warning.

Today I parked my car in a resturant parking area, when I came back I found a note on the car window saying that if I park there again they will call the breakers yard and have it towed away. I know I should not park in their space but is what they did legal and if they towed it away to to breakers yard what are my rights...

Come on legal eagles out there, advice please...

I will fight my corner about this...

They were being NICE and you _____?

You parked your can on private property without permission? Lucky for you they were being "Japanese" and just warning you. They could have had the car removed & stored at your expense and notified the police as well.

Please leave Japan. You give us Gaijin a bad name.

Am I a saint? hell no but if I had parked illegally in someones space and they left me such a note (and thats all) I would be giving them a "gomen nasai" rather then seeking revenge as you are.

Good legal advise? Dont park your car on private property.

What the hell DO you expect?

I went to the doctor the other day.

I said "Doctor. It hurts when I move my arm like this."

To which the doctor said, "Then don't move your arm like this."

My point is that if they told you not to park there, then don't park there. It was just a warning. They do have a right to tow your car away. But they didn't. Just avoid parking there. I am sure you know that in Japan parking is at a premium. I don't know where in Japan you are from, but private property is private property. If you don't repeat this, nothing more will come of this.

    Hope this was good advice.

Man, PJ....I know how you feel! The other I went to my friends house and had trouble finding a place to park so I just left the car in the middle of the street for a few hours. I figured people could just drive around it or take another route......but no!! Some ******* broke out my window! Hell, I pay taxes which in turn pay for the roads........I am entitled to park wherever I want!

To top it all off, whoever broke out my window stole the box of condoms that the Nova secretary gave to me when I asked for a "first aid kit". Hmm....guess no more safe-sex for Jackie......

Back in my country, if you park illegally you will be given an automatic fine and if you park in some restricted time zones the tow truck drivers will come in like vultures as soon as you break those time zone laws. In Japan, the parking attendants usually give a warning and leave it up to the offending person's good conscience to not do it again. However, I think this needs to change as Japanese people have changed and are more inclined to disobey these rules than maybe a decade ago. There is nothing that infuriates me more when people illegally park on streets. There is a "hokahoka" bento shop on the corner near me and although there is a carpark attached, a lot of lazy bums with their big box cars park out on the back street, right on the corner. If you are driving up that street, which I do all the time, you cannot see traffic that is coming from the right when you get to the top of the street. It's like playing Russian roulette when you pull out onto the street. This is just one example. I wish tow truck drivers would come along and tow people straight away when they illegally park, and give them a big fine too. There are signs on the street that mean "no parking", but nine times out of ten, they might as well not be there. One illegally parked car on the street can really affect the flow of traffic as all cars have to merge into one lane. Although where you parked probably didn't hinder other people so much, you were lucky that you got a warning and should count your blessings that you weren't fined, let alone have the gall to complain about it.

    "...what are my rights..."

You have the right to have your car towed away and impounded. You will then find out just how expensive illegal parking can be in Japan. You also have the right to be taunted mercilessly by the people who respond to your post. Presumably you are an adult, PJ. Time to start acting like one, IMHO.

Also, next time you think about parking illegally keep what happened to this woman in mind:

Hiyodori: Thanks for your advice. I won't park there in the future but I will use the park and use the resturant and then go about my business.

One other question about parking illegally, how about all those workers who park their cars in spaces before catching the bus to the city for the days work.....there will always be people who do this...

I like to fight city hall. Let me tell you about a friend of mine who parked in resident parking in my country, he was a builder collecting his tools, a traffic warden came and told him to move the car he said he would after he collected his tools, they gave him a ticket, he tore it up, the warden called the police and the arrested him.

The story finished with the flat owner going to the police station, waiting for 5 hours to see trhe chief police officer and complaining that a workman should have the right to pick up his tools and go away. The chief police officer agreed. He was sent a letter saying sorry.

Of course this is not relevent to my situation but I thought I would tell you anyway.

I am an adult older than you i'm sure.

I had that happened to me once when I parked there several times ( in the wrong area)! They were just being kind, in that states I would have been towed! I do have a question however it may or may not be relevant, but what is the proper etiquette in terms of taking action towards fellow neighbors, or just one actually. I live in the end home where the street is a bit narrow. In order for me to reach the main street I have to leave my house drive down the road just to find a neighbor always parks her car in middle where it is nearly impossible for me to get by. I get upset because I would think she would have some sense and realize that other people need to get back that live further down the street, right? I have been patient for over a year now, and I get upset because it is usually the time I go to work and have to wait, which makes me late at times!

Here is the second issue. The same neighbor, down the street always allows her children or play in front of my house, and right behind my car. They throw sticks, etc. Kids ,being kids. I can not be angry with them, but I am a bit perturbed about the parent allowing this. Why can`t they play in front of their own house and make noise there? I am also afraid is I get a scratch or damage, I can not point the blame unless I install a camera. I am not sure how to handle this! I want to go yelling my head off, but of course I want to follow proper etiquette in handling this, I have been a bit patient for over a year.

Thank you in advance for the advice.

    What do you call this???

The other day I had to go to a meeting, I did not park in the area I was told not to but parked in the supermarket, like many other people do.

The funny thing is that where I parked my car before and was warned not to park there anymore, it seems all the other teachers, (all being Japanese) continue to park in the same area, the owner knows this and has all the rego numbers but not one had a warning like me, I call this discrimination.

Let me hear what TH and co say to this...

why dont you ask your fellow teachers about it - maybe they can help.

you do seem somewhat confrontational about it all though - suggest you slow down and take things a little easier. You may be suprised the results you get with softly softly approach.

    Question.

I did ask my fellow teachers about this parking area, basiclly they will continue to park there.

Sorry Question, i'm not being confrontational about this, it just seems one rule for Japanese and one rule for me. What suggestion do you have??? GIVE UP...

I know i'm in the wrong about parking where I should not park, the resturant is correct and I am guilty of using his spaces but as I said before, he took all the car numbers but only I was told to move, maybe because I am not Japanese and I can't understand Japanese. Simple discrimination against me.

Yes. Everyone hates you and me and anyone else who uses their initials in place of their name or a handle.

Of course if this is some sort of dicrimination, confront it. You could kindly ask the manage why do you have to move and the others don`t? See what they say (he/she) says then? I would take it from there.

I know you are a bit angry about this, even though you did park in the wrong area. I did the same once because I could not read all the letters in Kanji, but they left a kind note on my car which said " Please do not park here, it is for the bank president" thank you for your understanding. I got the notice the third time I parked there, so I was lucky that they were being humane about the whole ordeal! Really, just try to address the manager who knowingly only asked you to move your car and not the others, from that point you can make a point with them, it may be a misunderstanding too.

By the way I was angry too, not because I was wrong and thought I was right, but out of embarassment with a sign hanging on my car! Yikes!
