    Default rear ended by a yakuza

    Once again, I am impressed by the tenacious skills of the Japanese police.

    Last night, while waiting for the traffic light to change at a very busy intersection, an idiot in a large white toyota hilux surf rammed my car from the left back.

    As per custom I got out and started shouting at him. But he was not alone. From his car poured a bunch of goons, from a honda stepwagon behind him poured more goons and from a benz slk one large tattood ____________.....

    they all started blah blah blah how they would fix the car for me... no need for the popo etc etc the one guy took my cellphone number... and they all buggered off....

    There was a helluva lot of shouting going on, mostly from their part... ut what they didnt notice while all this shouting was going on is that i got hold of the little bimbo from the 4x4 and told her to run into lawsons across the road and make a photocopy of her sweetie's (the driver) drivers license.
    The silly girl did...
    and of course i got the license plate number of the 4x4....

    i couldnt stay at the intersection so i drove to the nearest 7-11 and called the brave boys in blue....

    while i was waiting i received an assorted bunch of phone calls from a bunch of assorted badly spoken individuals... along the line of korrrrrra omae.... nande orrrre wo komasetorrrrrrrrru? omae darrrrrrrreeeeeee
    etc etc...
    my phone is set to reject unknown numbers ... so i have a lovely record of the calls...

    anyway... the pop arrived about 20 minutes later....

    we go through the whole story... show them the photocopy of the guy's license (the guy told us his name was nakamura but the license has a totally different name) and the license plate no. of the 4x4...

    they write down copious notes... radio in about the car.....
    then come back and ask me... am i sure it wasnt a BMW?
    no. i say.... it was a white hilux surf... a toyota... D says the same...
    okasi they say... the number is not for a toyota but a BMW...

    the number is really easy to remember... plus D just sent me the number by keitai mail while we were standing and having the shouting match with the tattood wonder from the benz...

    at 11 they called me to ask what work I did... but no update.
    at 1 am they called me (and woke me up) to ask the name of the company that I work for.... duh.......... i told them i was self employed when they called at 11.....

    and so the investigation continues.......... sigh

    my poor car and poor me...

    I hope you don't suffer any reprisals. I might have been tempted to take some money from them then and there, but who knows what the yaks would have done after.

    I'm sorry to hear about that Silk. I hope it all gets sorted soon and without fuss. Although this being Japan, it is never that simple. Here's hoping though.

    i think i might just call some of my own friends in low places ....
    this morning my phone has been ringing almost non stop with a variety of unknown numbers...

    the popoman has yet to put 2 and 2 together and realise that a license plate belonging to a BMW that is screwed to a toyota 4x4 usually means only one thing....
    they called again this morning to ask if i was completely sure the car wasnt a black BMW..........
    i told them to come and take paint samples off my car...

    i very much doubt that the brilliant leedle boys in blue are going to handle this one properly... and i do know some not so savory ppl myself...

    the only thing i REALLY worry about is the popoman giving out my name and address to the guy who was driving the big white toyota BMW...

    Jesus. That sounds like a nightmare. Seriously, how good is your Japanese? I'd get someone who speaks really well to go over it with you and go with you to the police, maybe talk to someone senior, and refuse to leave until they understand exactly what it going on.

    I wonder how inept the police really are, and how much of it is just bitching on this forum, but it doesn't sound like they've made a good start on it. Where are you, in Osaka or Tokyo?

    my japanese is basic fluent kansaiben..
    this is kobe... the home of the yakuza... sigh.
    i was thinking to go into the main hyougo kenkei today as all i got last night were 2 young 'uns on their funny little bikes from the local popobox.

    i was feeling sick and had a headache, as well as the fact my neck hurts... and they told me to go home and rest?
    i am not sure if it was the accident that gave me the headache or the constant questioning about toyota VS BMW.... they seem to think that if they ask me often enough, i will suddenly realise i was wrong and that it was indeed a black BMW.........

    i have had several very different experiences with the popo...

    a few years ago i was rear ended very badly while waiting in traffic at the expressway toll booth...
    the police were really kind and very efficient... they even let me come back the next day to give a statement because i was late for an appointment...

    my son was involved in an accident bike/4x4 ... he was on the bike...
    the policeman who came to the scene was drunk.. and the whole thing following was a bit of a fusk-up

    when my ex husband ran me over with my own car... well the popo was lacking in many ways... they spent hours trying to convince me that i should drop the whole issue... so badly trying to convince me that i really didnt even need to go to hospital..
    the domestic violence law had just changed and i think they really didnt know how to deal with it... or they didnt agree with it .. one or the other

    japanese friends have had cars stolen and houses broken into and the popo didnt even come to see the crime scene, just told them to come in and make a report...

    about a year ago i had my bag stolen and caught the girl who did it... the popo dealt with that in a very very good way... and a few weeks ago i was hittakuri and had my money stolen... the popo was helpful but very honest about probably not being able to do much about retrieving the money...

    so there are good and bad... efficient and bumbling... probably like most other countries.

    i tried that........ trust me... i said if you wont call the popo ...... pay for the damages now...
    when we tried to call the popo the guy grabbed my phone and turned it off.

    It's that glazed look in the eye, the eagerness to smile and the little trail of drool that gives them away every time.

    Popo janai desu. Simple Simone in a badly fitted blue uniform. They look good when they stand in the doorway of the koban though, don't they. Like models in toy town.

    Apparently it takes them about three months in Simple Simone school for them to become proficient in that stance and stare. They don't let them near the push-bikes until they can do that.

    Sounds like a shiti situation. Do you know anybody in the popo department? This would be the time to call and ask them to get involved. Also a lawyer. And put a bohan camera up in front of your house.

    unfortunately i a devoid of popo friends. i do know the odd tattood _______... some of them quite high level.
    but i would like to see what hyougo's finest is going to do first before i resort to alternative measures.

    one has to at least give them a chance, i suppose.

    honestly, i don't think those pops really want to deal with this issue...properly..that's why they kept asking stupid obvious questions over n over again..hoping you might get tired and change your statement ---that'd give them excuse to raise 'confusing statement' to go null.. i guess..

    In Australia you could report it to the police but your insurance company would do the dirty work.

    I was driving the car of a Japanese company in Australia with my Japanese boss and we were rear ended by a group of Italian guys from a panel beating shop. They were on their way to court because one of them was due to face some charges and they were driving a customer's car.

    They were obviously in a hurry but bent over backwards to help and offered to repair our car at their yard. I'm sure they would have done a good job.
    My boss was frustrated and unable to communicate in English. The fact that he preferred to get the car repaired through the company insurance was understandable but the fact that he was rude and pissed the Italian guys off was regrettable. He let his frustration get in the way of something that would have been easily negotiated by someone who was level headed and had a good grasp of the language.

    You get rear ended by a car. It's not a crime. I can see why you would want to report it to the police but do you want them to do exactly?
    The guys who ran into offered to fix it for you and have tried calling you but you don't communicate with them and insist on getting the police to do... what?

    Again, if it was Australia you would get in contact with your insurance company and give them the details of the car and the details of the person who ran into you. You would ask for their advice.
    The most likely next step would be to arrange to get your car repaired and you send the bill for repairs to the person who caused the damage. They can elect to pay cash or to pay through their insurer. End of story.

    Having rear ended a number of cars I'm fairly familiar with this process. I paid every time out of my own pocket. If someone had tried to get the police onto me I would have thought they were stupid.

    I think as long as the Blue Boys don't tell them where you live or your name (you didn't give them that I hope) you will be ok. Maybe call them and 'remind' them not to give it out.

    SOL- Is that the car you just got?

    Maybe a trip to the Marianas on your catamaran would be a good idea right now.

    I got the order wrong.
    The correct thing to do if rear ended by me in Australia is:

    1. Get my registration and licence number.
    2. Go home, take a shower (after reporting it to the police which I think your obliged to do if the damage is over $500)
    3. Call your insurance company and tell them what happened. If all you were able to get was my plates as I sped away then the insurance company will help track me down.
    4. Go to a panel beater and get a quote on the damage.
    5. Send a copy of the quote and a request for payment to the person who ran into you.
    6. If the person pays then that's it. Otherwise your insurer will help.

    Is it very different here in Japan? I still don't see why the police need to be involved if there was no crime. I guess having the wrong plates on a car is a crime of some kind but it's not something you need to be involved in.

    the guys who hit us have not called... at all
    some other unknown person called last night to shout korrrrrrrrrra omae etc etc at me before we called the popo... i asked him donata desuka?
    and his lovely answer was
    darrrrre demo eee jya nai?
    over and over until i hung up the phone.

    the reason we wanted to call the police was that D hurt his back in the accident.. and myself have a headache and neck pain... without an accident report from the popo no claim can be made to insurance for the medical bills.

    we wouldnt make anything because the guy has only jibaiseki.. and of course the guy who said he worked for a panel beaters... now we know he is a truck driver whos name is not nakamura like he said but namikawa...

    the lovely guy who called us to korrrrrrrrrra omae us last night is supposed to be the friend with the panel shop...

    went to the shimin hospital today... minimum 2 weeks injury... of course with no niin hoken involved we have to pay all medical costs... we knew that before we went, but last time i had an accident i never took the time to get proper treatment. this time i would like to not make the same mistake.
    D cant work for 10 days at least... which means a loss in salary of about 20man...
    its not in our financial interest to call the popo but just to get reinbursed for the medical costs...

    the popo also told us that they are unsure if the guy even has jibaiseki hoken....the shaken might have expired...and the number plate on the car is now something totally different and the popo is chalking it up to our mistake... we dont mind about that...
    we just want
    1) medical costs paid
    2) the car fixed
    3) no more harrassment....

    not too much to ask i think?

    Okay. Hospital bills to be paid. I've never hit anyone that badly.

    What did your insurer say?
    Is that "popo"?

    well yes ....
    if the guy has extra insurance ... then of course it is a breeze but in this case the guy has only jibaiseki (mandatory 3rd party) insurance..

    so the procedure
    get hit
    call the popo
    now if it is just vehicular damage.. blame will be allocated to each side...
    (in our case zero blame because we were stationary)
    then it is up to you and the person who hit you to sort things out by yourselves as 3rd party only covers people damage up to 120man yen.
    if you are injured...
    go to the hospital and get examined and treated... pay cash... kenko hoken does not apply so expect to pay 2 man plus just for the visit...
    pay another 2800 yen for a shindansyou which is basically a short note from the doctor stating your injuries and how long basic recovery might take.
    then go to the pharmacy and pick up your drugs and pay again 100$
    now take the shindansyou to the popo
    he will then file the accident as a jinshin jikou... an accident with injury.... he will ask you if you want them to penalise the guy or not.. its up to you...
    after that the popo tells you to go off and sort everything out yourself.

    to do this... you need a jikosyoumei from the police.
    this costs 600 yen
    you have to fill in a form and take it to the post office and pay the 600yen
    the popo will then within 2 to 3 weeks, send you the jikosyoumei...
    this you will need to give to the hospital and to the insurance company (3rd party ne) who will not ever call you about anything... you need to do all that...

    finally when all your treatment is finished.. you file claims for reinbursment of the medical costs by sending all the receipts etc and various forms to the other guys 3rd party carrier...
    and then you wait 3 to 6 months to get your money back....

    thats about it... except for all the fiddly fiddly fiddly details.

    basically the police do nothing more than take a piccie of your car... and write some silly report... the rest is up to you.

    the one popo was kind enough to tell us that we would probably be better taking things up with the small claims court ... fixing the car and selling it as quickly as possible. he reckons the guy will probably not pay anything.

    I'm pretty sure that in Australia the insurance company would help you track down the other person and make them pay. I've never had to do that by my father's adamant about it. His advice is never admit fault, get the person's details including insurer, ring your insurer and let them sort it out.

    pity about your dad though... i wouldnt mind having someone stubborn on my side...

    What's a popo?

    So the role of the police is to give a statement regarding the damage to the car, on the basis of which the "popo" attributes a percentage of blame to each party (zero in your case).
    It sounds like the police did their job as far as dealing with the accident, but not doing much if they can't help protect you from getting harrassed.

    Regarding the hospital I didn't know that your National Health Insurance didn't cover anything in the event of a car accident. I have heard that hospitals give priority to accident victims because they can charge them more money (I guess because third party insurance etc usually covers things).

    So the next step's the small claims court?

    Also, could they tell that the other guy didn't have any third party property from his licence details?

    Again comparing with Australia, my uncle got hospitalised for several months by and unlicenced driver and he still got compo from I think the government in the end.

    Don't worry about Dad. He's alive and well - just got back from a tour of Spain with mum. My wording was a bit off there. He's not in Japan but he's still kicking and causing insurance companies headaches.
