Nude images= defamation, harassment, etc?

One of my buddies here recently broke up with a girl he had been dating (he was about half moved into her place) and is having a ton of problems getting his stuff back. (LOL, I told him not to ____ her off until he had all his stuff back but some people have no patience) Now my friend is no saint but this girl is doing everything she can to make him miserable. Over the weekend they got into a heavy argument, he sent her a nude picture he had taken of her and threatened to post it as well as others/video online, etc. unless she returned his stuff. (He's a photographer and seems to think all the photos/video is his to use as he pleases as he's the author) According to what he told me, she seemed to back down after receiving his "threat" but is now threatening him with reporting the "threat" to the police. Assuming he's making any unreasonable demands of her, just the return of his stuff...is he at risk of any legal charges/police action being taken against him if he continues to use the images/video to threaten her or actually posts said images/video?

Its called distribution of pornography via a phone or electronic network and it doesnt matter if hes not getting paid for doing it or not. Hes risking some major jail time here.

So your "old buddy" does not have a computer, or GP account and cannot ask this for himself? Or.... you are the photographer in question? Or.... the old GF has confiscated your buddy's computer? Or... there is no such situation and you are planning to dump your GF and have some film stashed away?? Mmmmm.....

How's that? They were BF/GF and he took some photos of his beau. He's not obliged to get her permission before using them.

However, what he is doing is blackmail, I believe, and that is a punishable crime.

To the op:

He should have waited, but... some people have no patience at all.

My advice:

1. your 'friend' should go immedietly to the nearest koban, and report a laptop/memory stick/external hardisk type device stolen from his bag. The contents of the memory were personal files, including pictures, email etc. He is quite worried someone may find it and use it in ways that are hurtful to him or his loved ones. Voila, get out of jail card.

2. In the future, make sure he discusses any 'leverage' he may have only over the phone. Email in this case is just a bad idea.

Agree with Flipside-
If it’s out of his hands he can’t do anything about it can he? Also agree with phone correspondence so there is no physical evidence. However be aware she may be a crazy woman- speaking from experience here- she may actually record what you say on the phone. So if you think there is even a remote chance of this being the case be sure to say as little as possible on the phone other than you need to meet and talk to discuss things.

Yes, it's blackmail but from what I've seen, nothing else seemed to work. His excuse for resorting to this was it being faster and more effective than the court system here. (and he's probably right) He's not really a scummy guy, just needs better judgment in who he gets into relationships with. As for those of you who obviously think my friend is me, take a look at my other posts on GP, I have no shame in posting my own issues =) If you want to know why I'm posting and not him, like many of you, I have my own collections of ex gf's photos and when I heard what he was doing, it honestly made me curious. Going to give him flip side's advice but not recommend doing anything because he made the threats by keitai.
